1. Who we are and acceptance of these Terms

TravelViber is a brand of The Lime Agency LLC ("The Lime Agency", "TravelViber", "we", "us" or "our"). These Terms of Service ("Terms") form a binding agreement between you and The Lime Agency LLC and govern your use of the TravelViber website, apps and related services (the "Service").

By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What TravelViber is — and is not

TravelViber is an online venue where travelers can list, find, buy, sell, request or give away leftover goods and services from their trips, and contact each other to arrange an exchange.

We only connect users. We are not a party to any sale, donation or exchange; we do not own, inspect, hold or deliver any item; we do not process payments between users; and we are not a broker, agent, escrow service, auctioneer or insurer. Any agreement you make with another user — including price, payment and handoff (in person, by mail/courier or digitally) — is solely between you and that user.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You may not use the Service if we have previously suspended or removed your account, or if you are barred from doing so under applicable law.

4. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at [email protected] if you suspect unauthorized use.

A "verified" badge means our team has reviewed a profile; it is not a guarantee of a user's identity, honesty or the items they offer.

5. Listings and content

When you post a listing or other content you confirm that:

you own the item or are otherwise entitled to sell, give away or transfer it (including under any ticket, voucher or booking terms);
the listing is accurate, not misleading, and photos show the actual item;
the item is not prohibited under Section 6, and listing, selling and delivering it is lawful where you and the other user are located;
you will keep the listing up to date and mark it sold, donated or found once the exchange is complete.

Listings expire on the date you choose. We may remove or restrict any listing or content, at our discretion, that we believe breaches these Terms or the law.

6. Prohibited items and conduct

You may not list, offer or request:

illegal, stolen, counterfeit or recalled items, or anything that infringes someone else's rights;
weapons, ammunition, explosives or hazardous materials;
drugs, prescription medicines, alcohol, tobacco, vaping or cannabis products;
food that is not commercially sealed and within its use-by date;
passports, IDs, boarding passes, personal travel documents, or non-transferable tickets, passes, loyalty points or airline miles;
live animals, adult content or services, or anything restricted to licensed sellers;
gift cards or vouchers you are not entitled to transfer.

Foreign currency. You may offer genuine banknotes and coins left over from your own travel, in personal amounts. TravelViber may not be used to run a currency-exchange, check-cashing or money-transmission business, to move money on behalf of others, or for any activity that requires a financial license. We may remove currency listings at our discretion and may report suspicious activity to the authorities.

You also may not harass, threaten, defraud or mislead other users; send spam; collect other users' data; interfere with the Service; or use it for any unlawful purpose.

7. Dealing with other users

You deal with other users entirely at your own risk. We do not verify users, items or listings, and we do not supervise, guarantee or take part in any exchange. To the fullest extent permitted by law, The Lime Agency is not responsible for — and you release us from claims relating to — items that are not as described, defective, counterfeit or not delivered; payments or refunds between users; fraud or other misconduct by users; or loss, injury or damage arising from a meetup or exchange.

Please follow our safety tips: meet in busy public places, check the item before you pay, and never send a deposit or payment to someone you have not met. Report suspicious listings, messages or users with the in-app report tools.

8. Messages, offers and reviews

Messaging and offers exist so users can arrange exchanges. An accepted offer is an arrangement between the two users only; it is not a payment and does not create any obligation for us. We may review messages when they are reported or automatically flagged (for example, first messages containing links) and act on misuse.

Reviews must be honest and based on a real interaction. We may remove reviews that are false, abusive, retaliatory or that breach these Terms.

9. Reporting content, moderation and appeals

Anyone can report illegal or prohibited content using the report tools on listings, messages, reviews and profiles, or by emailing [email protected]. When we remove content or restrict an account we will, where required by law, tell you why, and you may ask us to review the decision by replying to our notice or contacting support. Users in the EU may also have the right to use a certified out-of-court dispute settlement body.

10. Intellectual property and copyright complaints

The Service, the TravelViber name and logo, and all related software and design belong to The Lime Agency LLC or its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service as intended.

You keep ownership of the content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce and adapt it (for example, resizing photos) for the purpose of operating and promoting the Service, until it is deleted.

If you believe content on TravelViber infringes your copyright, send a notice to [email protected] with: your contact details; the work you claim is infringed; the URL of the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and your physical or electronic signature. We remove infringing material and terminate repeat infringers where appropriate.

11. Fees

Using TravelViber is currently free. If we introduce paid features we will tell you the price before you are charged, and any additional terms will be shown at that time.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Service will be uninterrupted, secure or error-free, or that any content posted by users is accurate or lawful.

13. Limitation of liability

To the fullest extent permitted by law, The Lime Agency LLC and its members, officers, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from or related to the Service or any dealings between users. Our total liability for all claims relating to the Service is limited to the greater of US$100 or the amount you paid us in the 12 months before the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

14. Indemnity

To the extent permitted by law, you agree to indemnify The Lime Agency LLC against claims, losses and reasonable legal costs arising from your listings or content, your dealings with other users, or your breach of these Terms or the law. This section does not apply to consumers in the UK or EU to the extent local law does not allow it.

15. Suspension and termination

You may delete your account at any time from your profile settings. We may suspend or close accounts, or remove content, that we reasonably believe breach these Terms or the law, or put other users or the Service at risk. Where required by law we will give reasons and a way to appeal (Section 9). Sections that by their nature should survive termination (including 7, 10, 12, 13, 14 and 17) continue to apply.

16. Changes

We may update these Terms. We will change the "Last updated" date and, for material changes, notify registered users by email at least 14 days before they take effect. If you do not agree to the changes you can delete your account; continuing to use the Service after they take effect means you accept them.

17. Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual claims), are governed by the laws of the State of Florida, United States, and applicable US federal law, without regard to conflict-of-law rules. Subject to the paragraph below, you and we agree to the exclusive jurisdiction of the state and federal courts located in Florida.

If you are a consumer in the United Kingdom or the European Union, this choice of law does not deprive you of the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of that country as well as in Florida. Nothing in these Terms affects your statutory rights as a consumer.

18. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor of our business, and this will not reduce your rights.
